Administration ‘loses’ Padilla interrogation tape. Jose Padilla, a U.S. citizen, was detained for four years without formal charges, much of it in solitary confinement. An independent medical expert say his repeated interrogations have made him mentally unfit for trial. Now, the judge in Padilla’s case has ordered the administration to turn over all tapes made of his interrogations, specifically a session from March 2004 while he was still held as an “enemy combatant.” But the administration says it lost the tape.

U.S. District Judge Marcia Cooke was incredulous that anything connected to such a high-profile defendant could be lost.

“Do you understand how it might be difficult for me to understand that a tape related to this particular individual just got mislaid?” Cooke told prosecutors at a hearing last month
 

Senior Bush Official: ‘No Trend’ Showing Escalation Is Working
On Tuesday, President Bush gave a speech claiming the Iraq escalation is showing “encouraging signs” of progress. But in today’s Washington Post, a senior Bush administration official acknowledges that “right now there is no trend” showing the escalation is working.

Moreover, officials say the information Bush presented to back up his rosy claims was skewed or flat-out false. A fact check:

President Bush: “General Petraeus recently arrived in the Iraqi capital, and the plan he is executing is in its early stages. … Yet even at this early hour, there are some encouraging signs.”

FACT: “Sectarian attacks in Baghdad are down at the moment, but the deaths of Iraqi civilians and U.S. troops have increased outside the capital. … If violence is down in Baghdad, analysts said, it is likely because the Shiite militias operating there are waiting out the buildup in U.S. troops, nearly all of whom are being deployed in the capital. At the same time, Sunni insurgents have escalated their operations elsewhere.”

President Bush: “Iraq’s Council of Ministers recently agreed on legislation they will submit to their parliament on the development of Iraq’s oil resources and the sharing of revenues.”

FACT: “Though Iraqi leaders have agreed on a new framework law for oil resources, the details of how the oil revenue will be divided among competing Iraqi groups remain unresolved.”

President Bush: “The Iraqi government has completed the deployment of three additional Iraqi Army brigades to the capital. They said they were going to employ three brigades, and they did.”

FACT: “A senior U.S. military official in Baghdad said this week that two Iraqi brigades and one battalion of a third have arrived in Baghdad.”

President Bush: “Iraqi and U.S. forces have rounded up more than 700 people affiliated with Shia extremists.”

FACT: “Bush’s report…appears to have little to do with the new strategy. The number is ‘based on captures…since July 2006,’ the military official said. Bush first reported the same roundup — citing 600 captures — last fall.”

On the same day President Bush gave his speech last week, suicide bombers and gunmen attacked Shiite religious pilgrims, “killing at least 130 people in one of the deadliest days of the four-year war.”
 

Breaking: Nevada Fox News debate killed. “Senate Majority Leader Harry Reid (D-NV) and the Nevada Democratic Party announced today that they are backing out of a Fox News-sponsored presidential debate in August following Fox President Roger Ailes’s recent remarks comparing Democratic Senator Barack Obama to al Qaeda terrorist Osama Bin Laden. Fox News did not answer calls seeking reaction to the decision.”

Yesterday at the House Armed Services Committee hearing on veterans care, Rep. Phil Gingrey (R-GA) attempted to stand out from the rest of Congress and argue that the conditions in Building 18 weren’t that bad. Instead of criticizing the cockroach infestation, he said, “I was glad to know that those cockroaches were belly up. It suggested to me that at least someone was spraying for them.”

He also tried to blame the soldiers for the conditions, stating, “And, of course, if you leave food around in a motel room or a dorm room at a college, you’re going to get some mice show up at some point in time.” Watch it:

President Bush's troop buildup in Baghdad apparently will be bigger and more costly and perhaps last longer than it seemed when he unveiled the plan in January as the centerpiece of a new Iraq strategy.

U.S. officials say it's too early to tell whether the troop reinforcements will succeed in containing the sectarian and insurgent violence, but it looks as though the Pentagon is preparing for an expanded commitment assuming that by summer there are solid signs that the extra effort is yielding significant results.

The Bush plan called for sending 21,500 extra U.S. combat troops to Iraq mainly to Baghdad with the last of five brigades arriving by June. The estimated price tag was $5.6 billion. Officials have refused to say exactly how long it would last, but Defense Secretary Robert Gates had suggested that it could be over by fall.

In recent days a different picture has emerged.

Jeffrey Feldman calls it the new math. I've heard some grumblings that Bush is so intent on proving that his "surge" is working, that the military is underreporting incidents in Baghdad. Certainly, there has been no decrease in reported incidences on Iraqi sites. And far worse, now generals outside of Baghdad are calling for reinforcements. (h/t CS for links)

Bush's seven-day tour of Latin America includes a stopover beginning late Sunday in Guatemala. On Monday morning he is scheduled to visit the archaeological site Iximche on the high western plateau in a region of the Central American country populated mostly by Mayans.

Tiney said the "spirit guides of the Mayan community" decided it would be necessary to cleanse the sacred site of "bad spirits" after Bush's visit so that their ancestors could rest in peace. He also said the rites — which entail chanting and burning incense, herbs and candles — would prepare the site for the third summit of Latin American Indians March 26-30.

Bush's trip has already has sparked protests elsewhere in Latin America, including protests and clashes with police in Brazil hours before his arrival. In Bogota, Colombia, which Bush will visit on Sunday, 200 masked students battled 300 riot police with rocks and small homemade explosives.

The tour is aimed at challenging a widespread perception that the United States has neglected the region and at combatting the rising influence of Venezuelan leftist President Hugo Chavez, who has called Bush "history's greatest killer" and "the devil."

Iximche, 30 miles west of the capital of Guatemala City, was founded as the capital of the Kaqchiqueles kingdom before the Spanish conquest in 1524.
 

Polar bears, sea ice and global warming are taboo subjects, at least in public, for some U.S. scientists attending meetings abroad, environmental groups and a top federal wildlife official said on Thursday.[..]

The matter came to light in e-mails from the Fish and Wildlife Service that were distributed by the Natural Resources Defense Council and the Center for Biological Diversity, both environmental groups.

Listed as a "new requirement" for foreign travelers on U.S. government business, the memo says that requests for foreign travel "involving or potentially involving climate change, sea ice, and/or polar bears" require special handling, including notice of who will be the official spokesman for the trip.[..]

Two accompanying memos were offered as examples of these kinds of assurance. Both included the line that the traveler "understands the administration's position on climate change, polar bears, and sea ice and will not be speaking on or responding to these issues.

ACLU Considers Supreme Court Appeal in Case of Khaled El-Masri; Urges Congress to End Human Rights Abuses


NEW YORK – The American Civil Liberties Union today expressed its disappointment with an appeals court ruling upholding the dismissal of the case of Khaled El-Masri, an innocent victim of the CIA’s policy of “extraordinary rendition.”

Although El-Masri’s case has been discussed and investigated throughout the world, the Fourth Circuit Court of Appeals ruled today that it could not be either discussed or reviewed in an American court because of the government’s invocation of the “state secrets” privilege.

“Regrettably, today’s decision allows CIA officials to disregard the law with impunity by making it virtually impossible to challenge their actions in court,” said ACLU Executive Director Anthony D. Romero. “With today’s ruling, the state secrets doctrine has become a shield that covers even the most blatant abuses of power.”

The ACLU said it was reviewing the opinion and will consider an appeal to the United States Supreme Court.

The ACLU lawsuit charges former CIA director George Tenet, other CIA officials and U.S.-based aviation corporations with violations of United States and universal human rights laws. El-Masri was on vacation in Macedonia when he was kidnapped, abused and rendered to a CIA-run “black site” in Afghanistan. After several months of confinement in squalid conditions, he was flown from Afghanistan and abandoned on a hill in Albania with no explanation, never having been charged with a crime.

“Today the appeals court gave the CIA complete immunity for even its most shameful conduct," said ACLU attorney Ben Wizner, who argued El-Masri’s case before the Fourth Circuit last November. "Depriving Khaled El-Masri of his day in court on the ground that the government cannot disclose facts that the whole world already knows only compounds the brutal treatment he endured."

Wizner noted that El-Masri was allowed to travel to the United States last November to attend the hearing and to meet with Congressional officials. “Were there a shred of evidence linking Mr. El-Masri to terrorism, he would not have been released from American custody, nor would he have been permitted to enter the United States last November, observe judicial proceedings in his case, and freely walk the halls of Congress,” Wizner said.

Indeed, according to the Washington Post, at least eight U.S. officials have confirmed that El-Masri spent months in a squalid CIA-run prison because "a couple of CIA officials in Washington had a hunch he was someone he was not" and "did not move fast enough when they found out he wasn't."

At the November 28, 2006 hearing before the appeals court, the ACLU argued that the government is invoking the state secrets privilege to avoid accountability for the abuses it perpetrated against El-Masri rather than to protect sensitive national security interests. Based on official recognition of the rendition program and the volume of information on its widespread use both generally and specifically in relation to El-Masri, the ACLU argued that allowing El-Masri to litigate his claims further will not harm national security.

To date, El-Masri’s case has been described in literally hundreds of newspaper articles and television news programs – many of them relying on sources within the U.S. government. It has been the subject of numerous investigations and reports by intergovernmental bodies, including the European Parliament. Most recently, prosecutors in El-Masri’s adopted country of Germany formally requested indictments against 13 CIA agents and contractors for their role in his kidnapping, abuse, and detention.

Last month the ACLU sharply criticized the Bush administration for its refusal to sign an international accord regarding secret detentions and forced disappearances. “We urge Congress to shine a bright light on our government’s use of secret detention and rendition,” said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. “The Bush administration should stop stonewalling congressional efforts to examine these abuses of basic due process and human rights. Congress must permanently shut down these secret programs and facilities.”

WASHINGTON - As Attorney General Alberto Gonzales appeared before the Senate Judiciary Committee today, the American Civil Liberties Union called on panel members to hold the administration's feet to the fire for its approval of torture policies and warrantless surveillance. This will be Gonzales' first appearance before the committee under the new leadership of Chairman Patrick Leahy (D-VT).

"This is the first real test to see if the new Congress will conduct meaningful oversight on the administration - a test it must not fail," said Caroline Fredrickson, Director of the ACLU Washington Legislative Office. "We urge the attorney general to explain the Justice Department's justification of torture and increased secrecy. Lawmakers must reject any attempts by Mr. Gonzales to stonewall their constitutional duty to find out how laws Congress has passed are being implemented. We are looking to Chairman Leahy to bring back real oversight."

The White House and various agencies have blocked the oversight activities of Congress. Recently, the Justice Department refused to release to Senator Leahy key documents relating to the administration's torture policies. Senator Leahy had requested those documents last year when the government disclosed the existence of the documents in response to the ACLU's FOIA litigation. The failure of the government to provide that information makes it increasingly difficult for lawmakers to conduct meaningful oversight and ensure compliance with the law.

The ACLU also urged lawmakers to question the attorney general on the National Security Agency's warrantless surveillance program. The administration has yet to disclose the scope of the surveillance. On Wednesday, the Bush administration conceded that the judicial branch has a role in overseeing surveillance by the NSA.

Given the White House's expansive view of the power of the executive, the ACLU also urged the panel to question the attorney general about the limits on the "inherent powers" of the president. Lawmakers were also urged to examine reports of lax enforcement of civil rights laws by the civil rights and voting rights divisions of the Bush administration's Justice Department.

"For six years, the executive has denied Congress its right and responsibility to serve as an equal branch," added Fredrickson. "The voters' decisive voice last November is a reminder from Americans that we want Congress to stand up to this administration - not serve as its rubber stamp."

What is the legal basis for the government’s action? What safeguards are in place to protect basic privacy rights? How often have the Pentagon and CIA used this claimed authority, based on what criteria, and was compliance truly “voluntary” or effectively coerced?

“We call on Congress to investigate these issues immediately, especially in light of previous revelations that the Pentagon compiled anti-terrorism dossiers on domestic organizations that had done nothing more than peacefully exercise their constitutional right to protest."
